Kyrgyzstan to combat land squatting

President of Kyrgyzstan Sadyr Japarov signed a decree on measures to prevent and suppress the facts of illegal seizure of land. Press service of the head of the state reported.

It is noted that in recent years, the Cabinet of Ministers, local state administrations and local authorities have taken a number of measures to streamline and legally regulate the situation with the unlawful seizure of land and allocation of land in general.

In spite of the work carried out by state bodies, the practice of unauthorized seizure of land plots continues in violation of the law, including agricultural land for individual housing construction, as well as unauthorized extension of land plots at the expense of streets, green areas, adjacent territories; unauthorized seizure of land by organizations, institutions and enterprises takes place.

In order to prevent and suppress unauthorized seizure of land, the presidential envoys to the regions, heads of local state administrations, mayors of cities, heads of rural administrations in cooperation with law enforcement agencies and the authorized body for supervision and control over compliance with land and water legislation were instructed to:

  • Develop and adopt a set of measures to prevent and suppress the facts of illegal land squatting;
  • Systematically carry out explanatory work among citizens on the inadmissibility of unauthorized land seizure and on civil, administrative and criminal liability for such actions;
  • In order to prevent seizure of land plots and land plots allocated for capital construction objects and structures, information on the location of the borders of which are not included in the State Real Estate Cadaster, to carry out cadastral work to establish the borders of land plots;
  • Step up control over rational and efficient use of land plots allocated to land users for agricultural production as well as by owners of agricultural lands.

To the Ministry of Internal Affairs:

  • To step up the work on ensuring public order and taking exhaustive measures to identify and suppress the facts of unauthorized seizure of land and bring offenders to the responsibility established by the legislation;
  • To promptly consider the facts of illegal seizure of land plots owned by the state, municipal and private entities and to intensify preventive work with the persons involved in these unlawful actions.

The State Agency for Architecture, Construction, Housing and Communal Services under the Cabinet of Ministers was ordered to promptly consider the facts of unauthorized extension of the allotted or assigned land plots by citizens or legal entities in accordance with the Code of Offences and the Civil Code.
