The Ministry of Foreign Affairs of Kyrgyzstan expresses its concern over the decision of Tajikistan on mass deportation/expulsion of citizens of Kyrgyzstan temporarily staying on the territory of the republic. The Foreign Affairs Ministry reported.
According to the ministry, the decision of the Tajik authorities is an unreasonable step, taken without prior notification through diplomatic channels.
It is noted that, according to Article 36 of the 1963 Vienna Convention on Consular Relations, the competent authorities of the receiving state must immediately notify the consular post of the sending state, if a national of that state is arrested, imprisoned or detained pending trial within its consular district.
The Law on the legal status of foreign nationals and stateless persons in the Republic of Tajikistan establishes that the state body executing the decision to expel a foreign national and stateless person from the territory of the republic must notify diplomatic mission and consular offices of the foreign state whose citizen is to be expelled or resides on its territory.
According to the Ministry of Foreign Affairs of the Kyrgyz Republic, the relevant documents in relation of the deported citizens were not drawn up; the specific substantiated reasons were also not explained, information about offenses which served as a basis for their expulsion from the country was not provided to them.
On January 3, the Ministry of Foreign Affairs of the Kyrgyz Republic handed a corresponding note to the Embassy of the Republic of Tajikistan in Kyrgyzstan with a request to provide all necessary information about the reasons and legitimate grounds for deportation/expulsion of Kyrgyzstanis.
«The ministry proceeds from the firm position that all arising issues should be resolved through negotiations on the basis of friendly relations, using political and diplomatic means and respecting the universally recognized international legal norms,» the statement says.
Earlier, the Border Service of the State Committee for National Security of Kyrgyzstan informed that 50 Kyrgyzstanis were deported from Tajikistan to Kyrgyzstan.
