The measure of restraint to the former mayor of the capital, Albek Ibraimov, will be appealed in Bishkek City Court. His lawyer Sergei Slesarev told journalists.
He noted that yesterday the Pervomaisky District Court illegally chose a measure of restraint to the former mayor in the form of detention in the pretrial detention center of the State Committee for National Security.
«The Pervomaisky District Court still closes the hearings for journalists or those who want to attend them in violation of the law. The law says that a trial must be open. We challenged the judge, he rejected it. The defense drew attention to the fact that the investigation did not substantiate its request to recognize the detention of Albek Ibraimov lawful. The charge under the Article «Fraud» is not in the competence of the SCNS. The criminal case on which the charge was brought was instituted under the Article «Appropriation or embezzlement of entrusted property.» At the same time, the charge under the Article «Fraud» was brought without criminal proceedings,» said Sergei Slesarev.
He added that during the hearing the court was not provided with any document that would justify the position of the investigation.
«The court was not provided with evidence, facts related to the prosecution and the need to choose a preventive measure. Prior to detention, Albek Ibraimov was at home, was on vacation. He did not run away. The investigation attempted using the special forces and representatives of the bodies of inquiry to ensure his compulsory appearance in the State Committee for National Security, stating that he was hiding. Being at home, Albek Ibraimov could not hide. The only report from an investigative officer was present in the materials. The court was not provided with neither the summons, which were mentioned, nor with the resolution on the compulsory taking in court,» the lawyer said.
Recall, the ex-mayor of Bishkek was detained on the fact of misappropriation and embezzlement of property in Dastan TNC through purchase of special products at an overestimated price.
