Kubat Otorbaev: Karganbek Samakov must be acquitted

Ombudsman, Kubat Otorbaev, wrote a letter to the President Sooronbai Jeenbekov, the Supreme Court Chairwoman Ainash Tokbaeva and the Prosecutor General Otkubek Zhamshitov.

In his message, the Ombudsman stated all the evidence of the innocence of the ex-parliament member, Karganbek Samakov, and other convicts in this case.

In particular, addressing to the president, Kubat Otorbaev stressed:

«Dear Sooronbai Sharipovich,

Your words about the corruption, injustice of the judges, voiced at the meeting of the Judicial Reform Council, found a warm response and support among the lawyers, attorneys, human rights defenders and judges themselves. Your speech aroused a noble hope that the ice moved and the destinies broken in the courts will be restored.

On the basis of the foregoing, following the above mentioned facts, it should be noted that the case initiated against Karganbek Samakov has no elements of crime or any guilt.»

The Ombudsman noted the involvement of the former head of the Presidential Administration Department, Manas Arabaev, in the unjust judgment on Samakov’s case.

«I note that since the criminal case instituted against Karganbek Samakov is unfounded, it was investigated one-sidedly, in an accusatory manner, and the first court did not establish the truth on the merits and in essence, he must be fully acquitted within the currently undergoing trial in the appeals instance,» the Ombudsman believes.
