Economy Ministry opposes arrest of large entrepreneurs, initiates amendments

The Ministry of Economy and Commerce of Kyrgyzstan is against «excessive interference of state bodies in the activities of business entities.» It initiates amendments to the Criminal Procedure Code of the Kyrgyz Republic.

«The purpose of this draft law is to strengthen the protection of the activities of large entrepreneurs and investors in the Kyrgyz Republic and eliminate unjustified and excessive interference of state bodies in their activities. The constitutional norm that no one can be deprived of liberty solely on the grounds that he or she is unable to fulfill any civil obligation should be a guarantee not only for entrepreneurs, but also for all citizens,» the background statement says.

It is proposed to remove the words «or people, who caused damage on an especially large scale or committed acts associated with the extraction of income on an especially large scale» from the Paragraph 2 of Part 4 of Article 114 of the Criminal Procedure Code of the Kyrgyz Republic. In particular, detention will not be applied to large entrepreneurs engaged in economic activity.

The ministry noted that in this case, the proposed preventive measure for large entrepreneurs is house arrest and electronic surveillance, which allows for remote control and tracking of the location of the accused, using electronic and other technical means, in order to ensure that he/she complies with the prohibitions and (or) restrictions imposed on him/her.
