Kempir-Abad: Keneshbek Duishebaev demands to open case against President

Ex-secretary of the Security Council of Kyrgyzstan, Keneshbek Duishebaev, demands to prosecute the President Sadyr Japarov and Chairman of the State Committee for National Security Kamchybek Tashiev. Lawyer Akyn Avazbekov told 24.kg news agency.

According to him, the statement was submitted to the Prosecutor General Kurmankul Zulushev.

It states that on November 17, the Parliament approved a draft agreement between Kyrgyzstan and Uzbekistan on the demarcation of some sections of the state border. The document is expected to be signed by the head of state in the near future.

«According to the agreement, the entire territory of Kempir-Abad reservoir along the 900th horizontal line, half of the dam, two hydroelectric power stations located on the Kyrgyz side, become the property of Uzbekistan, and the new border line will run along the strategic Bishkek — Osh road, coming close to Uzgen. The official authorities did not disclose the contents of bilateral negotiations, the protocol on the border to the people and the public of the country, citing secrecy and allegedly at the request of the Uzbek side,» the statement says.

President Sadyr Japarov and deputy head of the Cabinet of Ministers Kamchybek Tashiev, who is also the chairman of the state commission for demarcation and delimitation of the border, have repeatedly stated: the issue of transfer Kempir-Abad reservoir to Uzbekistan is their initiative and decision. In this way they solve all complex issues of borders and this is in the interests of the Kyrgyz Republic.

In his statement, he points out that well-known politicians, public figures, journalists, bloggers, who openly expressed disagreement with the position of the authorities, were subjected to mass repressions, criminal prosecution, and arrests. At the same time, any arguments that the Uzbek side should fulfill its obligations to compensate for economic damage in connection with the flooding of fertile arable land, the rise of groundwater in the settlements of Osh and Jalal-Abad regions were not accepted.

The damage, according to the ex-Secretary of the Security Council, is $1.5 billion.

«The Water Code says that the water resources of Kyrgyzstan are the exclusive property of the state and cannot be alienated. The Constitution states that the territory of the Kyrgyz Republic within its borders is integral and inviolable. In addition, the Basic Law stipulates that the land, its subsoil, airspace, flora and fauna, and other natural resources are the exclusive property of our republic. There are signs of grave and especially grave crimes in the actions of Sadyr Japarov and Kamchybek Tashiev,» he writes.

Keneshbek Duishebaev demands to initiate a criminal case under the articles «Treason», «Abuse of official position by a person in a responsible position», «Excess of power by a person in a responsible position» of the Criminal Code of the Kyrgyz Republic.

«In the case of committing these grave and especially grave crimes, it is necessary, according to the Constitution, to begin the procedure for removing Sadyr Japarov from the post of head of state,» he emphasizes.

In addition, the former Secretary of the Security Council demands to bring the investigators, who opened a criminal case against activists and politicians, who opposed the transfer of Kempir-Abad reservoir, to justice.

On November 17, the Parliament ratified an agreement between the Cabinet of Ministers of Kyrgyzstan and the Government of Uzbekistan on the joint management of the water resources of Kempir-Abad reservoir and an agreement between the two countries on separate sections of the state border.

Sultanbai Aizhigitov, Zhanar Akaev, Nilufar Alimdzhanova, Seidbek Atambayev, Omurbek Bakirov, Dastan Bekeshev, Emil Zhamgyrchiev, Tazabek Ikramov, Nurzhigit Kadyrbekov, Adakhan Madumarov, Iskhak Masaliev, Talant Mamytov, Mirlan Samiykozho, Elvira Surabaldieva, Emil Toktoshev, Azamat Israilov, Erulan Kokulov and Chingiz Aidarbekov voted against.
