Draft law on NGOs will be improved - Murat Ukushev

One of the authors of the draft law on NGOs, an employee of the Presidential Executive Office, Murat Ukushev, said today at the round table «National Dialogue — the Right to Freedom of Association» that the document drafted on Old Square and submitted for public discussion earlier would be changed and finalized taking into account the comments of representatives of the civil sector.

According to him, a working group will be created, which may include civil activists and independent lawyers. «The first version will be improved taking into account all the comments and suggestions received. Tomorrow, on December 20, the first meeting of the working group on the draft law on mass media will take place. It has 21 members, 15 are representatives of the media, and six are officials. If necessary, if representatives of the NGO community do not object, we are ready to form a working group to finalize the draft law on NGOs similar to the working group on the draft document on the media,» Murat Ukushev said.

He added that the Presidential Executive Office and the Ministry of Justice were currently working on an inventory of existing laws. «We are moving towards the fact that all regulatory legal acts that were adopted from January 1, 1991 to January 1, 2010 are recognized as invalid by 80 percent. In general, we declared about 6,000 documents invalid,» Murat Ukushev said.

The Presidential Executive Office demonstrates that they are ready for dialogue, but the member of the right-wing parliamentary faction Ata Zhurt Kyrgyzstan, Nadira Narmatova, who on November 21 submitted for public discussion amendments to the laws «On Non-Commercial Organizations», «On State Registration of Legal Entities, Branches (Representative Offices)» and the Criminal Code, avoids open discussion. She did not come to today’s round table.

Meanwhile, in their expert interim opinion, representatives of the OSCE/ODIHR conclude that her initiatives are incompatible with international human rights standards and OSCE commitments. The organization recommends the author to withdraw her amendments.

Lawyers of Adilet Legal Clinic also call on Nadira Narmatova to withdraw the document amending the laws «On Non-Commercial Organizations», «On State Registration of Legal Entities, Branches (Representative Offices)» and the Criminal Code since its adoption in the presented version is inexpedient and unacceptable.

Being a deputy of the fifth convocation, Nadira Narmatova, in collaboration with Tursunbai Bakir uulu, proposed a similar document. About 80 percent of it was copied from the Russian document. The draft law was rejected in the third reading by the members of the sixth convocation in 2016.
