We need institute for assessment of activities of judges - President

«In order to solve existing problems in the judicial system, it is necessary to create an institution for assessment of the performance of judges,» Sadyr Japarov suggested, speaking at a meeting with the judiciary during a visit to the Supreme Court. Press service of the President reported.

The head of state, stressing that a lot of work has been done in the judicial system in a short time, noted the importance of implementation of the long-awaited reforms.

According to him, there are many important facts that are often mentioned in civil society and among ordinary people, causing discontent. The activities of investigating judges in the judicial system cause great dissatisfaction.

«According to the requirements of the law, the main duties of an investigating judge are to supervise the investigative work of investigators and prosecutors, prevent them from circumventing and exceeding the law, and protecting human rights. But even so, it is observed that investigating judges in the modern judicial system do not fully use their legal rights and turn into instances that satisfy the requests and requirements of the investigating authorities in their own interests,» Sadyr Japarov said.

The President gave an example: when choosing a measure of restraint for the accused, even if there are legal grounds, they are limited to the arrest proposed by the investigating authority.

The head of state noted that one of the important issues that should be paid attention to is the violation of the deadlines for hearing court cases.

«Such situations arise mainly due to the weakness of the chairmen, their failure to fulfill their duties, and unsatisfactory organizational work. For example, duration of the court hearings themselves, on average, does not exceed an hour. However, the interval of the next hearing, for various reasons, is set from a week to a month, and the period for hearing of the case, which can be considered and completed in a short time, is unreasonably delayed. This is due to the fact that complaints against judges who act in this way are not unambiguously considered, appropriate disciplinary measures are not taken under various pretexts, suspicious and justified complaints from our citizens arise. According to the principle of competitiveness, if the guilt of the accused is not proven, an acquittal is issued. I believe that only then the quality of the investigation will improve and it will meet the requirements of the law,» Sadyr Japarov said.

The bitter truth is that the judges did not observe the principle of competition between the parties and made a decision only on the basis of the materials of the prosecution and the investigation. Such moments, of course, increase the frustration among the public.

The President, as a way to solve the aforementioned problems, pointed to the need to create an institution for assessing the activities of judges. If the work of each judge is assessed objectively and transparently, they will be fairly rewarded or punished. The head of state also noted the slow execution of court decisions. In particular, more than 70 percent of unexecuted decisions in civil cases are noted.

«If they have been litigating for years, if decisions made in court are not executed, if the issue that concerns the parties is not resolved, then what kind of trust can citizens have in the judiciary, the general executive power and me, as president. The above mentioned is only a small part of the problems in the judicial system that needed to be solved a long time ago. You, like no one else, know and see all the shortcomings, since you are directly involved in all lawsuits. Make proposals so that we can change society through joint efforts,» Sadyr Japarov added, pointing out the important role of the Supreme Court in solving these problems.
