The Constitutional Chamber declared the paragraph 8 of Article 46 of the External Migration Law unlawful. The lawyers of Adilet Legal Clinic informed 24.kg news agency. The decision was made today at a hearing, where the relevant request of lawyers was considered.
Article 46 regulates the grounds for temporary restrictions in the right of Kyrgyz citizens to leave the country. The ban on traveling outside the country in civil cases has been declared illegal by the Constitutional Chamber.
Earlier, the court banned the head of Adilet Legal Clinic, Cholpon Dzhakupova, and journalists Dina Maslova and Naryn Aiyp to leave the country because of civil proceedings.
«The Constitutional Chamber confirmed that this rule contradicts three articles of the Basic Law. The interests of the plaintiff were placed above the interests of the defendant. From now on, the court can not forbid to leave the country on this ground, if the civil case is not closed,» representatives of Adilet said.
