Draft Digital Code submitted for public discussion in Kyrgyzstan

The Ministry of Digital Development of Kyrgyzstan has submitted a draft Digital Code for public discussion.

It is noted that the draft Digital Code is the result of a large-scale analysis of the branches of the legislation of Kyrgyzstan and the study of the best world practices in regulating the digital environment. Adoption of the draft code, which unites legal regulation and systematization of all technological legislation, will create a favorable regulatory legal environment that will lay the foundation for the development of the digital economy in Kyrgyzstan.

«Results of the successful implementation of this task will have a positive impact on economic growth, improve the provision of services by the state and the private sector, and lead to the creation of a more favorable investment climate,» the Ministry of Digital Development believes.

According to the idea of the drafters, it «should build a unified system of public administration in the field of digital technologies and ensure the application of uniform rules for regulating public relations related to the use of digital technologies.»

A unified system of digital management of the country will be created. Digital assets, artificial intelligence, robotics, blockchain are listed as modern innovative solutions, implementation of which will be controlled by a separate package of bills.

The authors admit that the structure of e-government bodies is in fact non-working, the current principles are outdated, and therefore they must be updated.

The draft says that entire industries are cut off from electronic document management or other digital interaction. Therefore, the legislation of the Kyrgyz Republic in the digital sphere needs to unify various sources of information, acting in the form of traditional media and new types of media — social media, channels in instant messengers, which «requires a review of the activities of various media based on the general principles of content neutrality.»

The Digital Code will only control data and infrastructure, but will not regulate content.

Public relations related to processing of digital data, including using the Internet, fall within the scope of the the Digital Code of the Kyrgyz Republic.

Separate sections of the document are devoted to such areas as «National Digital Ecosystem», «Artificial Intelligence Systems», as well as «Digital Wellbeing Services», «Digital Registries» and so on.

Earlier, the Minister of Digital Development Talantbek Imanov stated that the Digital Code is a unique set of rules. Its main goal is to unite all digital norms into a common legal field, which will give a new impetus to the development of the economy and accelerate the process of digitalization in the republic.
