Bermet Baryktabasova: Laws protecting doctors do not work in Kyrgyzstan

It becomes dangerous to be a doctor in Kyrgyzstan. The head of the independent medical trade union Bermet Baryktabasova posted on Facebook.

According to her, the rules and laws that protect doctors do not work.

«If you are a doctor in Kyrgyzstan, you are already guilty. Doctors in many cases continue to be judged by judges and accused by prosecutors, in spite of and contrary to all medical laws, common sense and the laws of nature. Succumbing to the «grief and suffering» of patients-litigants, prosecutors, judicial and investigative authorities continue to bend the hand of Themis against health workers who acted within their functional duties and professional duty,» she believes.

Bermet Baryktabasova wonders what doctors should do when they acted according to books and textbooks, according to orders and laws, and they are prosecuted for this?

«Prosecutors and investigators often force or «recommend» doctors to pay compensation to a patient with complaints, regardless of the validity of the complaint,» she added.

She stressed that doctors almost always pay to extortionists. It doesn’t matter whether they are guilty or not. The amount of compensation for moral damage reaches unimaginable sizes: from $1,000 to $200,000. Even venerable surgeons are not paid so much.

The head of the trade union appeals to representatives of supervisory and judicial-investigative bodies with a request not to offer doctors to pay to litigious patients or their relatives. «Show your legal powers, and if there are no grounds, why do you open criminal cases? And if you have already opened, then why are you waiting for years, not closing them, even when all the commissions made their decisions unanimously?» she noted.

She added that all parties need to stay in the legal field, investigate all the cases thoroughly, involving local and foreign medical professionals, and not indulge in accusations and claims.
