Minimum wage planned to be increased 3.5 times in Kyrgyzstan

The Ministry of Labour, Social Security and Migration of Kyrgyzstan proposes to invalidate the law on minimum wages in Kyrgyzstan. The relevant bill has been submitted for public discussion.

As the background statement says, the goal of the bill is to bring the legislation on the regulation of the minimum wage in line with the Basic Law of the country.

Article 42 of the Constitution states that everyone has the right to receive wages not lower than the subsistence level established by law.

«The law on minimum wage provides that the amount of the minimum wage is established by the law on the republican budget for the corresponding year, based on the principle of its gradual increase to the subsistence level of an able-bodied person,» the document says.

However, until now, the minimum wage has not been raised to the subsistence level, which is 3.5 times lower than its size.

The ministry added that, therefore, the establishment of the minimum wage, based on the principle of its gradual increase to the subsistence level of an able-bodied person, does not comply with the requirements of the Constitution.

The Ministry also proposes to amend the Part 1 of Article 154 of the Labor Code as follows: «The minimum wage is set for unskilled labor simultaneously throughout the territory of the Kyrgyz Republic in the amount of the subsistence level for an able-bodied person.»

The subsistence level in the second quarter of 2021 reached 6,268.31 soms.
