The head of the Supreme Court of Kyrgyzstan, Zamirbek Bazarbekov, asks to cancel probation supervision for rape. He said this in an interview with journalists.
According to him, not only judges, but also the laws themselves are to blame for the fact that non-custodial sentences are imposed on criminals.
«Because the Criminal Code allows probationary supervision for rape. Therefore, given the public’s discontent and the fact that such crimes are committed against women, children, Parliament should amend the laws. The judiciary has been given the opportunity to amend the laws. But lawyers are well aware of this and the common people should also realize that judges cannot ask to pass laws with aggravating circumstances. We, on the contrary, take into account mitigating circumstances. So state prosecutors should ask to cancel probation for rape. And we will work within the framework of the adopted legislation,» Zamirbek Bazarbekov said.
The head of the Supreme Court of the Kyrgyz Republic previously noted that a proposal was sent to the Council of Judges to remove from office a judge of the Sokuluk District Court, who applied probation to the accused for repeated rape of Asel Nogoibaeva.
Recall, 36-year-old Asel Nogoibaeva was admitted to the hospital with stab wounds on September 20. Her ex-husband Azamat Estebesov cut off her ears and nose and mutilated her body. The fact was registered under Article 130 «Causing grave harm to health» of the Criminal Code of the Kyrgyz Republic. A criminal case was initiated. 39-year-old former husband of the victim was detained. The investigation continues.
