Kyrgyzstan fails to conduct effective, thorough investigation into Inandi's case

Kyrgyzstan did not conduct an effective and thorough investigation into the disappearance of Orhan Inandi. Conclusion of the UN Committee against Torture says, Taalaigul Toktakunova, the lawyer of the director of Sapat international educational institution, told 24.kg news agency.

Before the appearance of Orhan Inandi in Turkey, he was kept at the Turkish Embassy in Bishkek.

The document refers to the Article 55 of the 1963 Vienna Convention, which provides for respect for the laws and regulations of the host state. In addition, the UN Committee cites the second part of the article, which states that consular premises should not be used for purposes incompatible with the performance of consular functions.

«It is known that the embassy building is considered as the territory of another country. Therefore, consular staff have immunity. It is prohibited to conduct searches and investigations by the investigating authorities in the building. In its conclusion on the case of Orhan Inandi, the UN Committee cites an international norm, according to which investigators of Kyrgyzstan could carry out investigative measures, if there are traces of a crime or obvious reasons for this. We had an assumption that our citizen was unwittingly kept in the embassy building. But nobody checked it. The conclusion also says that, despite the rallies, the demands of the public, the investigators did not conduct an investigation in the institution,» Taalaigul Toktakunova stresses.

The UN Committee against Torture also came to the conclusion that in the case of Orhan Inandi, kidnapped, tortured and brought to Turkey, Kyrgyzstan did not comply with Article 3 of the UN Convention against Torture, which states that no state party should expel, return or extradite a person to another state, if there are serious grounds to believe that he may be in danger of being subjected to torture there.

It should be noted that at the session of the UN Committee against Torture, which is being held in Geneva, Kyrgyzstan will report on the country’s fight against torture.

The UN reminded the Kyrgyz delegation of the abduction of Orhan Inandi and the extradition of the Uzbek journalist Bobomurod Abdullayev to Uzbekistan.

The committee noted that Kyrgyzstan does not grant a refugee status to people who are persecuted, but, on the contrary, extradites them to states where they will be subjected to torture.
