MP demands resignation of head of Constitutional Court

The head of the Constitutional Court of Kyrgyzstan should resign. Deputy Zhanar Akayev stated at a parliamentary session.

According to him, the court made a dangerous decision, allowing initiation of criminal cases against a deputy without the approval of the Parliament.

«It is written in the Constitution that a deputy cannot be prosecuted for the opinions expressed in connection with his or her activities or for the results of the voting. It is possible to bring a deputy to criminal responsibility only with the consent of the majority of the total number of deputies of the Parliament, except when he or she is caught red-handed at the crime scene. Taking into account the decision of the Constitutional Court, we should then change the regulations. When I asked why such a decision was made, who defended the rights of the Parliament, it turned out that some Tolondu Samakov went to court. He stated that it is also possible to initiate a criminal case against parliament members without permission, as well as against other citizens. What are we going to do now? Parliament has not given any response since May 23. Its consent to initiate a criminal case against the deputy is necessary, because we must ask why they want to bring him to justice. Does it mean that we won’t be able to talk about anything here except for agriculture? The system should not work for one person only. I believe that the head of the Constitutional Court should resign,» Zhanar Akayev said.

Earlier, the Constitutional Court ruled that the consent of the Parliament to initiate a criminal case against a deputy is not required from now on. The court noted that the mechanism that set the need to obtain the consent of the Parliament to initiate a criminal case against a deputy was disproportionate to the goals of legal immunity.
