Kyrgyzstani sentenced to 5 years for participation in hostilities in Ukraine

The Naryn Regional Court sentenced Beknazar Borugul uulu to five years in prison for participation in the war in Ukraine in the ranks of Wagner PMC. Azattyk reported with reference to the wife of the convicted Dilbara Turusbek kyzy.

The verdict was delivered on December 7, 2023, but it became known only on January 4, 2024. The wife of the convict said that they would appeal to a higher court.

«The court hearings are not over yet. The case will be considered in Bishkek,» she said.

According to the law, the man can file a cassation appeal against the decision of the regional court. According to information on Sot.kg website, on October 5, 2023, the Naryn City Court sentenced Beknazar Borugul uulu to five years in prison. The verdict describes in detail, based on his words, the circumstances that forced him to sign a contract with the recruiters.

It is reported that Beknazar Borugul uulu, who left in 2020 to work in Russia, was sentenced there to 10 years in prison «for transporting drugs.» Being aware that citizens of Kyrgyzstan are prohibited from participating in military operations abroad, he voluntarily entered into a contract with the private company and went to war. He participated in hostilities in Ukraine from November 5, 2022 to July 6, 2023, received the medal «For the Capture of Bakhmut» and 1,514 million rubles.

The verdict says that the accused Beknazar Borugul uulu partially admitted his guilt and asked for an acquittal, since he ended up in the war not of his own free will, but to get rid of suffering in the colony and return to his family. He said that «on November 1, 2022, representatives of the Wagner PMC came to the high-security penal colony where he was serving his sentence and offered to participate in hostilities. They promised: if he remains alive, he would be granted Russian citizenship and he would return home. In case of death, his relatives will receive financial assistance.»

Having disagreed with the decision of the Naryn City Court, Beknazar Borugul uulu appealed to the regional court. The regional court found the 27-year-old man guilty under Article 256 of the Criminal Code (participation of a citizen of the Kyrgyz Republic in armed conflicts or hostilities on the territory of a foreign state or undergoing training to commit a terrorist act) and sentenced him to five years in prison. Earlier, 31-year-old Kyrgyzstani Askar Kubanychbek uulu was sentenced by the Pervomaisky District Court to 10 years in prison. On June 7, the Bishkek City Court upheld the verdict. However, the cassation appeal of Askar Kubanychbek uulu was considered in the Supreme Court on August 30, and the case was sent to the Pervomaisky District Court for reconsideration.
