MP accuses ex-Prosecutor General of Nariman Tyuleev’s property raiding

Deputy of the Parliament of Kyrgyzstan Ryskeldi Mombekov, during the report of the Prosecutor General, asked Otkurbek Dzhamshitov how legitimate confiscation of property from the former Deputy Prime Minister Askarbek Shadiev was.

The head of the supervisory body replied that there was a court verdict in force, according to which the property of Askarbek Shadiev had to be confiscated.

Ryskeldi Mombekov agreed with the legality of the verdict against the fled ex-official, noting that the court decision stated that Askarbek Shadiev was sentenced to imprisonment with confiscation of property.

However, according to the deputy, as for the case of the ex-mayor of Bishkek Nariman Tyuleev, court verdict does not imply confiscation of property.

Ryskeldi Mombekov believes that the previous government violated the law, as well as the constitutional rights of the Tyuleevs.

«Nariman Tyuleev has served his sentence, recovered the damage in the amount of 61 million soms. Why is his property and the property of his relatives confiscated? The former Prosecutor General acted as a raider; he violated the constitutional rights of the citizen Tyuleev and the Criminal Procedure Code. The examination confirmed that the verdict does not contain «confiscation» word. However, the property was taken away from both Tyuleev’s father and other relatives,» he said.

Earlier, the State Property Management Fund explained why it confiscated the building of SapatCom business center from the ex-mayor of the capital, Nariman Tyuleev. Officials referred to the court decision.

By the Decree of the Supreme Court of the Kyrgyz Republic dated November 30, 2015, judicial acts of the courts of first and second instances regarding confiscation of movable and immovable property in favor of the state were upheld.

Caravan shopping center, owned by Nariman Tyuleev, was also transferred to the state. However, the court sentences do not contain orders on confiscation of property from Nariman Tyuleev and his relatives.

Ryskeldi Mombekov reminded Otkurbek Dzhamshitov that the most flagrant violations of the Criminal Procedure Code were made by his predecessor. The deputy believes that the main supervisory authority has every reason to resume investigation on the basis of newly discovered evidence. The Prosecutor General agreed with the arguments of Ryskeldi Mombekov.
