Kyrgyzpatent proposes a draft resolution on the implementation of the new law on Trademarks, Service Marks, Geographical Indications and Appellations of Origin of Goods. The document has been submitted for public discussion.
Requirements to the content of the application and attached documents, methods of filing an application not only in paper but also in electronic form are described. The norm of publication of applications after preliminary examination, for familiarization of third parties, has been introduced. The terms of the main examination have been reduced from 12 to 7 months. In general, this draft regulates the issues of drafting, filing, consideration and examination of an application for trademark registration.
At the same time, in accordance with the law, a new object of intellectual property «geographical indication» has been introduced into civil turnover. Applicants will be able to register and use this designation, which identifies a product as originating from the territory of a country or a region or locality where a certain quality, reputation and other characteristics are associated with its geographical origin.
