Ombudsman.kg. Who will protect him and whether it is necessary?

It seems, the deputies of the Kyrgyz Parliament decided to early dismiss the Ombudsman of the country. The main human rights activist, obliged to be out of politics, didn't escape the temptation to enter into an unequal game.

"Non-flying weather"

When ombudsman institution was created the KR, it was assumed that this would be an independent body designed to protect the rights of citizens. However, in practice it turned out differently: all three Ombudsmen - Tursunbai Bakir uulu, Tursunbek Akun and Bakytbek Amanbaev - were politicized and played with the White House. After the introduction of the parliamentary form of government, Ombudsman became a lamb for the slaughter of the deputies. A precursor of the job at the institute of the Ombudsman became the report, presented the day before, which was recognized unsatisfactory by the members of the parliament.

By the way, parliamentarians didn't manage to hear a report of Bakytbek Amanbaev at the first attempt. This question was removed from the agenda several times. Sometimes there were no conclusion of the Accounting Chamber, sometimes Ombudsman was absent. As it turned out, the latter considered trip abroad more important than the report. Business trip length of 10 days still was interrupted. Not warm reception was waiting for him in the Parliament.

Politics swallows up 

Predecessor of Amanbaev - Tursunbek Akun also was sent back home early. After the scandal with the sensational release of the "kingpin" Aziz Batukaev. Akun calls himself a victim of political intrigue. Intrigue in the history of Batukayev was enough, we must admit. But this story didn't teach a lesson for Bakytbek Amanbaev. For example, revelations of some deputies in the lobby. They admitted that Baktybek Amanbaev - in general, unknown second-rate clerk - managed to climb into the seat of the Ombudsman of the country largely due to kinship with the deputy Urmat Amanbaeva (his sister), to money and the so-called southern factor. Regional lobby in the parliament was stronger than party affiliation.

As a consequence, the new Ombudsman wasn't welcomed to the court of the opposition and the authorities also didn't like him. Agree, it's a great chance to revive the independence of the Institute chief human rights defender of the country. But Bakytbek Amanbaev didn't take a chance. He accepted the rules of the game of big and dirty politics.

Amanbaev, whose office is littered with hundreds (if not thousands) of complaints and letters with the cries for help, began not with the ordinary people, desperate in the unequal struggle with the bureaucratic and police indifference or banal bureaucracy and red tape.

He rushed to defend... the rebellious villagers of Saruu, nightmarizing the top management of the Kumtor gold company for a long time. Then, even the president didn't understand the Ombudsman. Almazbek Atambayev criticized the human rights activist.

Amanbaev always promptly responded to attacks on government opponents and urged not to violate the rights of the opposition. And the White House and the pro-government deputies also didn't like it.

An experienced player would immediately understand that clouds are gathering. But Amanbaev is not like that: demonstration neglect on the part of the head of state, who had never accepted the Ombudsman, didn't become the wake-up call for him. Instead, he got used to the role of the Ombudsmen and began to... solve problems of his own well-being and career development. Bakytbek Amanbaev suddenly decided that his status is too small. He began to write letters, saying that the status of the ombudsman is equal to the rank parliament's speaker. This means that the salary should be corresponding. Then official cars seemed not prestigious. Then a little gasoline. The need a good and expensive laptop. Deputies even called Amanbaev to moderate appetites. But he didn't hear.

Skeleton in the closet

In general, the third Ombudsman of the country has no any feeling of self-preservation. Last year, he was also nearly dismissed. Even a special commission was established. Then the danger was over. This time he can't all the sins attributed to the predecessor. There is still troubled history with the last place of work. Recall that in 2008 audit the Chamber of Accounts revealed financial violations in work of the advertising department of OTRK (Public Broadcasting Channel), which was headed exactly by Bakytbek Amanbaev from 2005 to 2007. The audit concluded, as a result of undercutting tariffs for showing materials, the treasury received 49 million soms.

Then the scandal with Osh saunas broke out, where in fact brothels with prostitutes were kept. According to the police, brother and sister - the Amanbaevs Bakytbek and Urmat owned private baths. To be more precise, they own premises, where police officers discovered dens. However, the CEC deprived the deputy Amanbaeva of the mandate. She is now a defendant in the criminal case. She is accused of corruption. Of course, the ombudsman brother once said: sister - the victim of unprecedented third forces, avenging him, the guardian of all powerless and vulnerable. Well, it is a tradition in Kyrgyzstan. No one was surprised.

He was offended

The head of the relevant committee, who also estimated his report as unsatisfactory, had to keep his word during reporting of the ombudsman in the Parliament.

Natalia Nikitenko told her colleagues, many deputies have not received a specific answer to raised questions. "There is no political motive in this evaluation. The report of the ombudsman voiced general data on public servants violating the rights of citizens, but he could not tell specific names. It was told about the results of the audit of the Accounts Chamber, personnel matters," she explained.

Bakytbek Amanbaev staked his all, using the parliamentary rostrum. He became irritated and accused deputies of bias and violation of international acts. It did not help. The majority put him "unsatisfactory" mark.

Political prejudice of the solution to get rid of Amanbaeva was obvious. The deputies, as they often do, put all eggs in one basket - the ombudsman was accused of even small salaries of state employees. Then they find fault with the style of writing of the report. Some imagined that only ... NGOs write reports in this way, and not otherwise.

Only the Vice Speaker Bodosh Mamyrova intervened on behalf of the ombudsman. "He (Amanbaev) revealed irregularities in a particular area. But it is wrong to hang the blame on him. For example, raising teachers' salaries is not the responsibility of the ombudsman, but the government. And whether the Ombudsman should deal with supervision of government regulations? Let us then determine where functions of the Ombudsman end. If we are going to hang the whole blame on him, then he won't work at all," she urged colleagues.

As usual, the opposition appeared in time: a sin to miss this chance. Ravshan Zheenbekov and Omurbek Abdyrakhmanov believe that many do not like activism of the ombudsman, unaccountable to authorities, and therefore they intend to remove him. However, the majority has made already the decision, "unsatisfactory", and that's all! According to the law, this report isn't approved in the Parliament rand entails early termination of powers of the Ombudsman.

The Parliament will create a special commission, which will decide the fate of Mr. Amanbaev. The decision must be made no less than two thirds of votes of the total number of commission members. However, it is no secret how these commissions work in our country. A final decision depends on someone, who will stand at the head of it and its structure. If requested, this issue can be resolved quickly, and can be delayed so that there won't be the fifth convocation.
