Subsoil users to be able to develop deposits without land transformation

Subsoil users will be able to develop deposits and engage in geological prospecting without land transformation. This became possible after the signing by the President of Kyrgyzstan Almazbek Atambayev of the law on introducing amendments to the legislative acts in the sphere of land use.

The International Business Council noted that the adopted law provides for amendments to the Land and Forestry Codes, the Law on the Transfer (Transformation) of Land Plots. So, the amendments exclude the need for land transformation for subsoil use purposes. The law enters into force ten days after the day of its official publication.

Now, for exploration and development of mineral deposits, it is necessary to obtain the right to use the land for the term of the license. In most cases, licensed areas are located within agricultural land, stock, forest land and similar areas.

During the transformation procedure, which can last up to two to three years, the subsoil user does not have access to the license area and is forced to stand idle. At this time, other licensing conditions are not fulfilled, there is a risk of revocation of the license.

«Provision of land for exploration and development of minerals without transformation into another category of land will allow subsoil users to start work on geological exploration and development of fields faster. It is gratifying that the opinion of the business community is taken into account. Now not only mining companies will get the opportunity to work without hindrance, the state and local communities will benefit from the results of their activities," Askar Sydykov, director of the International Business Council said.
