The Supreme Court of Kyrgyzstan has started hearing of MegaCom case. The lawyer of the ex-adviser to the former head of Alfa Telecom CJSC Almazbek Abekov, Abaz Mambetakunov, told 24.kg news agency.
According to him, the hearing was scheduled for the middle of April, but it was repeatedly postponed. The last time, the reason was the illness of the judge, who was supposed to be the rapporteur on the part of the state prosecution.
The lawyers representing the interests of Abekov demand to send the case to a new investigation.
In its turn, the state prosecution wants the court to review the decision of the previous instance court in a civil suit. According to the Prosecutor’s Office, Almazbek Abekov and the former head of the company Azamat Murzaliyev should compensate for the damage in solidarity, not individually. The day before, the court read out all the above mentioned complaints and recommendations.
Abaz Mambetakunov asked for recusal of the rapporteur — judge Akhmatov, arguing that he was a distant relative of Almazbek Atambayev, but the Supreme Court rejected it.
«I also stated the second petition: to supplement the materials of the criminal case with judicial acts on the second episode, on which Abekov was convicted. He was found guilty of repairing the building of Alfa Telecom and was recovered 41 million. I attached seven documents, five of them are judicial acts, which testify that there is no such episode, and my client was convicted on it," Abaz Mambetakunov said.
The court hearing will continue today. The sentence is expected to be announced.
According to the verdict of the first instance court and the Bishkek City Court, Almazbek Abekov, former adviser to the head of Alfa Telecom CJSC, received 25 years in prison with confiscation of property and must pay 91 million soms in favor of the mobile operator.
The court sentenced Azamat Murzaliev to 12 years in prison with confiscation of property. Director of the company Novostroy Service Aman uulu Kenzhebek by court order will spend 8 years in a penal colony. The court found them guilty of all the incriminated acts.
