Kyrgyzstan not to withdraw private garden spaces for public needs

The Ministry of Justice of Kyrgyzstan believes that it is necessary to retain the provision on inadmissibility of withdrawal of private garden spaces in the Land Code.

«The Government of the Kyrgyz Republic has worked out and approved amendments to legislative acts in the field of land use. The original version of this draft law stipulated to exclude Article 46 of the Land Code, which establishes the rights to a land plot at the house and prohibits its withdrawal for state and public needs. These amendments have caused concern among the private sector, that is why civil activists made a number of statements," the department notes.

The Ministry of Justice also expressed its concern over the introduction of the above mentioned amendments.

Parliamentary hearings and meetings with representatives of non-governmental organizations and the private sector were held in order to discuss the draft law. As a result, Article 46 was retained, that is, private garden spaces will not be withdrawn. These amendments are currently being considered in the Parliament.

Note, Bishkek residents held rally in autumn of 2016 demanding to withdraw the amendments to the Land, Housing and Civil Codes.
