Kazakhstan proposes to amend one of key agreements of CSTO countries

The Ministry of Defense of Kazakhstan proposes to amend the Agreement on the status of the formations of forces and means of the CSTO collective security system. The document is posted on the website of open regulatory legal acts.

The agreement is amended to improve the legal framework for the presence of the Collective Security Forces in the territories of the CSTO member states.

It is proposed that the formations of the sending party be sent to the territory of the receiving party in the following cases:

  • In accordance with the official request of the receiving party to exercise the right to collective defense in the event of a threat or commission of an armed attack (aggression) against one or more parties, to counter other challenges and threats to collective security, to prevent (resolve) crisis situations, to eliminate emergency situations, to provide humanitarian aid;
  • To participate in joint exercises and surprise inspections.

The decision on the deployment, tasks, composition, number of formations, the order of their subordination, locations, as well as the time of stay on the territory of the receiving party to perform tasks for their intended purpose is taken by the CSTO Collective Security Council on the basis of an official request from the receiving party.

The formations are transferred to the subordination of the formation command after their commanders (chiefs) report to the formation command on crossing the border of the receiving party.

The decision on the transportation of formations to the territory of the receiving party by the party carrying out air transportation in the interests of the sending party is taken by agreement between these parties.

In the event of the use of formations by decision of the council, the receiving party notifies the other parties in writing of the place, time, and procedure for the intended crossing of its state border determined by it and creates the necessary conditions for the unimpeded and free movement of military echelons, aircraft and sea vessels and ships, motor convoys with personnel and movable property on its territory, and provides free accommodation and use of real estate.

In this case, flights of aircraft are operated along routes, as well as in zones (areas) that are agreed upon with the interested parties.

When transporting (transiting) formations to solve tasks for their intended purpose in cases of a threat or commission of an armed attack (aggression), countering other challenges and threats to collective security, preventing (resolving) crisis situations, eliminating emergency situations and providing humanitarian aid, the reception, dispatch, airfield technical (airfield) support, provision of parking places and protection of aircraft at airfields regardless of their ownership are carried out by the receiving or transit party free of charge. Air navigation services for flights of aircraft of state (military) aviation of the parties are carried out without charging a fee (fees).

Refueling with fuel, lubricants, special liquids and gases of aircraft at state (military) and civil airfields is carried out by the forces and means of the transit or receiving party on the basis of the relevant agreements and arrangements.
