Constitutional Court deprives Nursultan Nazarbayev of Yelbasy status

The Constitutional Court of Kazakhstan considered an appeal of a group of deputies of the Parliament on recognizing the law on Yelbasy as invalid. The website of the Constitutional Court of the Republic of Kazakhstan reports.

On January 5, they asked for an official interpretation of Paragraph 4 of Article 62 of the Constitution of Kazakhstan. The deputies also asked to answer the question whether the constitutional law on the First President of the Republic of Kazakhstan — Yelbasy was subject to recognition as invalid due to the exclusion of the norms governing his status and powers.

«Based on the will of the people of the Republic of Kazakhstan, expressed at the republican referendum of June 5, 2022, on the exclusion of Paragraph 4 of Article 46 and other norms from the Basic Law, it is decided to recognize that at present there are no legal grounds in the Constitution for the preservation of the constitutional law on the First President of the Republic Kazakhstan — Yelbasy in the current law of Kazakhstan, in connection with which it is subject to recognition as invalid,» the ruling of the Constitutional Court says.

On December 28, 2022, the Majilis accepted for consideration the document on the abolition of the law on the first president — Yelbasy.
