It is proposed to fine parents who refuse to treat children in Kyrgyzstan. Deputy of the Parliament, Gulkan Moldobekova, submitted the draft law for public discussion.
Background statement says that the bill was developed to lower the age at which a minor has the right to independently interact with any medical institution on issues of examination, obtaining information and treatment, including taking tests for HIV / AIDS.
MP found a contradiction in the legislation of the country.
It is that minors can independently receive information about their health and give consent to medical intervention from the age of 16, but undergo a medical examination for HIV / AIDS only from the age of 18. Therefore, it is proposed to set a single age — 14 years.
The proposal to set the age of 14 years is due to the fact that a minor takes an independent decision on certain issues under a number of Kyrgyz laws.
The document notes that the parents of a child are responsible for the failure to comply with medical prescriptions regarding health, deliberate refuse to turn for medical help if this turned out to be harmful to health, and for leaving a child in danger.
To increase the responsibility of parents, it is proposed to supplement the Code of Offences.
It is proposed to set punishment in the form of a fine for parents / persons replacing them for evading a medical examination of a minor, fulfilling medical prescriptions, refusing medical intervention in cases when there is a real threat to the life or health of a minor.
